Red Robin Gourmet Burgers, Inc., and its subsidiaries and affiliates (“Red Robin”, “we” or “us”) are committed to protecting the privacy and security of personally identifiable information (“PII”) that you provide in connection with your application for employment or your employment with Red Robin. This includes when you provide PII to us through Red Robin’s recruitment website located at www.redrobin.jobs, our employee website www.myworkday.com/redrobin, any other Red Robin Team Member self-service websites or portals (collectively, the “site”), or accessing these sites by application through a computer, tablet, phone or any type of device. You may also provide PII to us in writing from time to time or if you volunteer such information to us during the course of your employment.
You may report violations of this policy anonymously and confidentially through EthicsPoint by calling 1-877-733-9876 or online through www.redrobinhelp.com. If there is an immediate threat to Team Member personal information, please contact Red Robin’s Chief Privacy Officer at PrivacyOfficer@RedRobin.com to expedite investigation of the incident. Reports through EthicsPoint may not receive an immediate response.
By entering the site, applying for employment, continuing your employment with Red Robin, or reviewing/signing an employment related document electronically or on paper, each where PII is collected, you acknowledge and agree with the following:
Collection of Team Member Information
Red Robin is authorized to collect the information in any form it obtains through your use of the site, application for employment, continued employment with Red Robin, and your submission of employee related documents, including but not limited to the PII you submit in connection with your employment or intended employment (collectively “Employee Information”). Examples of Employee Information collected in connection with your employment or application for employment includes but is not limited to: your name, date of birth, government issued identification (passport, social security number, driver’s license number), banking information, marital status, health information, phone number(s), personal e-mail address, physical/mailing address, other contact information, title, employment history, education, job qualifications, and other relevant personal data. We also collect some of this information about your dependents when you provide it to us when you enroll in health and other benefits or provide contact information. By providing personal information about family members or other individuals, you represent that you have their consent to provide this information to us for the purposes set forth in this policy. Red Robin may also collect Employee Information in the form of physiological biometric data, like fingerprints, from our directors and officers for various licensing requirements. Except as required by law, you may opt-out of the collection of physiological biometric data. However, such opt-out may affect your workplace duties and responsibilities. Employee Information does not include any information that is available to the general public and excludes information generally available on a business card.

Sharing of Employee Information
Red Robin shares your Employee Information with third parties who provide outsourced human resource functions to us. Those third parties are required to protect your Employee Information. Such third parties include, but are not limited to, Workday, ADP (to file taxes), Equifax (I-9 management with E-verify), and other benefits providers. Red Robin may disclose your Employee Information if required or permitted to do so by law (such as when part of a governmental agency action or litigation), governmental or quasi-governmental requests, or a regulatory organization, or to relevant third parties such as site technicians, brokers, auditors, lawyers, or professional advisors. In the event that Red Robin considers it necessary or where required by law to disclose Employee Information in certain situations where the health, safety or wellbeing of a Team Member is at imminent risk, we may share your Employee Information with our outside lawyers, law enforcement or others who are legally authorized. As Red Robin continues to develop our business, we may buy or sell assets. In the unlikely event that Red Robin or substantially all of our assets are acquired, Employee Information may be one of the transferred assets.
Storage and Retention of Employee Information
Employee Information may be stored in hard copy or electronic format within the Home Office, a restaurant location, or in the cloud in the United States or other countries where Red Robin, its affiliates, agents, or contractors conduct business. Your Employee Information may be transferred into our human resources systems and used to manage your employment, may become part of your personnel file, and may be used for other work-related purposes. Your Employee Information will be kept for as long as is legally required, and in some instances longer depending upon the needs of the organization and industry practices.
Modification of Employee Information And Your Access
With some limited exceptions, you have the ability to directly access, review the accuracy of, and, if necessary, modify your Employee Information through the site. You may contact your human resources representative to request access to your Employee Information so that you may confirm its accuracy, amend any inaccuracies, and update it as necessary. We will evaluate requests to remove non-essential Employee Information, if permitted by applicable law. In some circumstances we may not agree with your request to change your Employee Information and will instead append an alternative text to the record in question. We will also evaluate your request to obtain a copy of business records containing Employee Information. Depending upon where you live, we may or may not be able to provide you with copies. Check with your human resources team to determine whether you may access and/or obtain copies of records.
Use of Employee Information
In accordance with applicable law, Red Robin may use Employee Information to evaluate applications for employment, manage work-related aspects of the employee-employer relationship (i.e., training, payroll, benefits, travel, reimbursement expenses, performance appraisals, succession planning, Team Member health and safety), investigate and respond to any claims related to your employment, and comply with applicable laws and regulations. Your Employee Information will not be used for direct marketing purposes by us or any third party service provider, unless you specifically consent to such use.
Protection of Employee Information
Our site contains links to other sites. Red Robin is not responsible for the privacy practices or the content of other websites. Statements here, elsewhere on the site or any other documents provided by Red Robin concerning the treatment of your Employee Information may not apply with respect to information already in Red Robin’s possession, such as information obtained by Red Robin in connection with your former employment, or information that is publicly available to Red Robin.
